1. Introduction and Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer") and 3DColorPop ("we," "us," or "Company") regarding your use of our 3D printing services.

By requesting a quote, placing an order, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

2. Our Services

3DColorPop provides professional FDM (Fused Deposition Modeling) 3D printing services, including:

• Custom 3D printing of customer-provided designs
• Material selection and consultation
• Design optimization recommendations
• Post-processing services (where applicable)
• Delivery and shipping services

All services are subject to our capabilities, material availability, and technical feasibility. We reserve the right to decline orders that are not suitable for our FDM printing processes.

3. Ordering Process

3.1 Quote Requests

• Quotes are provided based on the information and files you submit
• Quotes are valid for 30 days unless otherwise specified
• We reserve the right to revise quotes if project specifications change
• Quotes do not constitute a binding contract until formally accepted

3.2 Order Confirmation

• Orders are confirmed upon receipt of signed agreement and payment
• We will provide order confirmation with expected delivery timeframes
• Any changes to confirmed orders may result in additional charges and delays

3.3 File Requirements

• Accepted file formats: STL, OBJ, STEP, and 3MF
• Files must be printable using FDM technology
• Customer is responsible for file accuracy and printability
• We may request file modifications for optimal printing results

4. Pricing and Payment

4.1 Pricing

• All prices are quoted in British Pounds (GBP) and include VAT where applicable
• Pricing is based on material usage, print time, complexity, and post-processing requirements
• Additional charges may apply for rush orders, special materials, or complex geometries
• Shipping costs are calculated separately unless otherwise specified

4.2 Payment Terms

• Payment is required before production begins unless credit terms are agreed
• We accept bank transfers, credit/debit cards, and other approved payment methods
• For large orders, we may require a deposit with balance due before shipping
• Late payment may result in order delays and additional charges

5. Production and Delivery

5.1 Production Timeline

• Standard turnaround time is 3-5 working days from order confirmation
• Express services may be available for additional charges
• Timelines are estimates and may vary due to order complexity or material availability
• We will notify you of any significant delays

5.2 Delivery

• Delivery methods and costs will be agreed upon before order confirmation
• Risk of loss transfers to customer upon delivery to the specified address
• Customer is responsible for providing accurate delivery information
• We are not liable for delays caused by shipping carriers or incorrect addresses

6. Quality Standards and Specifications

We maintain high quality standards for all printed parts:

• Parts are produced using professional-grade FDM printers and materials
• Dimensional accuracy is typically ±0.1mm to ±0.3mm depending on geometry
• Surface finish is consistent with FDM printing technology limitations
• Colors may vary slightly from digital representations

FDM printing has inherent limitations including visible layer lines, potential support marks, and material-specific characteristics. These are normal aspects of the FDM process and not considered defects.

7. Intellectual Property

7.1 Customer IP Rights

• Customer retains all intellectual property rights in their designs and files
• We do not claim ownership of customer designs or printed parts
• Customer files are kept confidential and not shared with third parties

7.2 Customer Obligations

• Customer warrants they own or have permission to use all submitted designs
• Customer agrees not to submit designs that infringe third-party intellectual property
• We reserve the right to refuse orders that may violate intellectual property rights
• Customer indemnifies us against any IP infringement claims related to their designs

8. Prohibited Items and Uses

We reserve the right to refuse orders for items that are:

• Illegal, weapons, or weapon components
• Adult or sexually explicit content
• Hateful, discriminatory, or offensive materials
• Designed to circumvent security measures or enable illegal activities
• Unsafe for FDM printing or handling
• Infringing on intellectual property rights
• Medical devices requiring regulatory approval
• Items intended for food contact without appropriate materials

9. Warranty and Returns

9.1 Limited Warranty

• We warrant that printed parts will be free from material defects for 30 days
• Parts will substantially conform to agreed specifications
• Warranty covers manufacturing defects, not design limitations or normal wear

9.2 Returns and Refunds

• Custom printed parts are generally non-returnable unless defective
• Defective parts will be reprinted or refunded at our discretion
• Returns must be reported within 7 days of delivery
• Customer is responsible for return shipping costs unless parts are defective

10. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claim is limited to the value of the specific order
• We are not liable for indirect, consequential, or punitive damages
• We are not responsible for delays caused by factors beyond our reasonable control
• Customer assumes all risks related to the use of printed parts

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded by law.

11. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, material shortages, equipment failures, or other unforeseeable events. In such cases, we will make reasonable efforts to fulfill orders as soon as possible.

12. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by ourPrivacy Policy, which forms part of these Terms.

By using our services, you consent to the collection and processing of your information as described in our Privacy Policy.

13. Modifications to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Significant changes will be communicated through our website or by email.

Continued use of our services after changes constitutes acceptance of the updated Terms. Orders placed before changes take effect will be governed by the Terms in effect at the time of order.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the English courts.

We encourage customers to contact us directly to resolve any concerns before pursuing formal legal action. We are committed to working with customers to find fair and reasonable solutions to any issues.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any order-specific agreements, constitute the entire agreement between you and 3DColorPop.
